This username or account is not to be shared, loaned, transferred or sublicensed to any other person or party.

4.2. Children below 13 years of age should refrain from registering in Yuvaink. Any content of theirs could be posted by their parents by creating the account in name of the parent.

(iv) Use any process, whether automated or manual, to capture data or content from Yuvaink or its users, including but not limited to screen-
scraping;
(v) Use Yuvaink or any process to damage, disable, impair, or otherwise attack or hack our Services or the networks connected to Yuvaink;
(vi) Interfere with anyone’s use and enjoyment of Yuvaink;
(vii) Solicit login information or access an account belonging to someone else; or

If you participate in any feature on Yuvaink that allows users to share, modify, or combine user content with other content, you grant us and our users an irrevocable, royalty free, perpetual, worldwide right and license to use, share, reproduce, modify, create derivative works, display, distribute and perform your content on Yuvaink. You acknowledge that any content you post on public areas on Yuvaink may be searchable online.

If you use any Yuvaink mobile applications that provide messaging communications and location features with your mobile device, You acknowledge and agree that information about your usage of Yuvaink may be communicated to us by third parties, such as your telecom provider. We may obtain information from your telecom provider about the type of device you are using. Certain features of our Mobile Services may collect the phone number of your device. We may associate that phone number to the mobile device identification information; however, we will not use that number for telemarketing.

10. Termination and Cancellation

10.1. We or You may cancel your access and use of Yuvaink at any time for any reasons in our discretion including your breach of these Terms of Use. We will try to provide advance notice to you prior to our terminating your account but we may not do so if we determine it would be impractical, illegal, not in the interest of someone’s safety or security, or otherwise harmful to the rights or property of Yuvaink.

12. Limitation of Liability

14. Disputes, Governing Law and Venue

14.1. Yuvaink shall not be held responsible for disputes arising out of interactions between members / users. Yuvaink reserves the right, but has no obligation, to become involved in any way with these disputes. The Site is intended for use by users located in India. We in no way imply that the materials on our Site are appropriate or available for use outside of India. If you use our Site from locations outside of India, you are responsible for compliance with any applicable local laws. The terms shall be governed by the laws of India without regard to its conflict of law principles.

15. Non Transferability

15.1. You agree that your account on the Site is non-transferable and any rights to your Account ID or contents within your account terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.

TO THE MAXIMUM EXTENT PERMITTED BY LAW YUVAINK AND ITS AFFILIATES OR ASSOCIATES WILL NOT BE LIABLE TO YOU UNDER ANY THEORY OF LIABILITY—WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE—FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, PUNITIVE OR SPECIAL DAMAGES OR LOST PROFITS, EVEN IF YUVAINK OR ITS AFFILIATES OR ASSOCIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

The limitations set forth in this section will not limit or exclude liability for the gross negligence, fraud or intentional misconduct of Yuvaink or its affiliates or associates for any other matters in which liability cannot be excluded or limited under applicable law.
